TERMS & CONDITIONS - Commissioned Photography


WIL:HAUB photography will keep copyright of the images produced unless agreed in advance and in writing. Copyright may be available to purchase and the price will be negotiated on a case-by-case basis.

The Client will be granted a license to reproduce and/or distribute the photographs produced under contract. All licenses have geographical, time, media and usage restrictions. All licences are granted on a non-exclusive basis unless otherwise agreed between WIL:HAUB photography and the Client. Use of the photographs outside the terms of the license granted would be a breach of contract, license and copyright.



If additional license rights are required post agreement, it is possible to extend the license to accommodate the updated requirements at an additional negotiated cost.



Delivery options will be agreed as part of the commission. Options include secure web galleries, Dropbox, WeTransfer or email. Photographs will be supplied in the agreed format within the agreed deadline. Copies of all files will be retained in WIL:HAUB photography’s archive. Re-issue of any or all of the image files will be subject to an additional charge.



Fees and costs will be negotiated and agreed in writing before the commission takes place. Should the details of the commission change, alterations to the costs will be agreed in writing prior to the execution of the commission. Commissions will be subject to acceptance of the terms and conditions described herein. Once the commission has been completed the Client will be invoiced according to the agreed payment terms and conditions. The grant of license will only come into force once payment has been made in full. Postponing or cancellation of the commission within 3 days of the start time will result in a charge of 50% of the agreed fees. Postponing or cancellation within 24 hours of the start time will be charged at 100% of the agreed fees. WIL:HAUB photography’s payment terms are 30 days from date of invoice. Late payments will be billed a £10.00 per month handling fee and the Late Payment of Commercial Debts (Interest) Act 1998 will be enforced.



WIL:HAUB photography does not accept liability for unexpected events or those outside of WIL:HAUB photography’s reasonable control including: poor weather, industrial disputes, sickness or injury, equipment malfunction, model release disputes, property release disputes and other actions or accidents that cannot be reasonably predicted. WIL:HAUB photography carries £1 million of Public Liability insurance. Any additional insurance requirements will be negotiated as part of the commission.



If the Client is not satisfied with the output produced by WIL:HAUB photography the first approach to dispute resolution will be to discuss the issues and attempt to agree a suitable solution. Be aware that best efforts will be used to produce the output required by the commission. Due to it’s nature, photography is subjective and, whilst best efforts will be applied to photograph to the brief given in the commission, the accuracy of the photographs to the brief will be dependent on the quality of the brief and the prevailing conditions.
